Domestic Workers' Bill of Rights: New York Passes Legislation

York became the first state to pass legislation that provides domestic workers with basic labor protections. The state Senate passed the legislation, S 2311, also known as the Domestic Workers' Bill of Rights, in a 33-28 vote. The bill sets out the responsibilities of employers and employees as well as rules for paid holidays, paid vacations and standard overtime, as well as other labor standards common in other federally protected industries.

The New York Senate and the Assembly, who passed similar legislation in June 2009, will now work together to combine the different versions. If the legislation is successful, New York’s Domestic Workers' Bill of Rights could serve as an example for other states.

Traditionally, domestic workers, such as nannies, housekeepers, and elderly caregivers privately employed, are excluded from federal labor laws. As a result of limited labor protection, domestic workers have been known to face both exploitation and abuse in the workplace It is estimated that there are 200,000 domestic workers in New York that could benefit from this legislation.
