Construction Company to Pay $154,000 in Back Wages
Urban Concrete Contractors Ltd. of San Antonio has agreed to pay 77 current and former construction workers $154,189 in back pay after the Labor Department said it found that the company had violated the overtime provisions of the Fair Labor Standards Act (FLSA).

Wage and Hour investigators say Urban Concrete Contractors, which provides new and reconstruction services, paid its non-exempt construction workers on a day rate basis without regard to the number of hours worked. Investigators say the firm initially took the position that these construction workers were independent contractors rather than employees. Additionally, the company failed to maintain time records of hours worked, according to the DOL.

"Overtime is important to people, and the Department of Labor is committed to vigorous enforcement of the law to make sure workers are paid fairly for all hours worked," says Tammy D. McCutchen, administrator of the department's Wage and Hour Division.

The department says the company cooperated fully during the investigation and agreed to pay the workers their back wages.
