New FMLA Rules Should Arrive Soon

The Department of Labor has submitted a final draft of new Family and Medical Leave Act regulations to the Office of Management and Budget (OMB) for review.

The department submitted the regulations to the OMB on October 20, 2008. If the OMB approves the regulations, they could be published as early as November (for the rules, the OMB has a final action date of November 2008 but no specific day).

In February 2008, the department proposed new Family and Medical Leave Act regulations and asked the public to comment on them. The department hasn't disclosed to what extent it changed the regulations based on feedback from the public.

The February 2008 proposal covered several areas of the Family and Medical Leave Act, including notice requirements, medical certification, and the definition for "continuing treatment" of a serious health condition.
