Supreme Court to Review Healthcare Reform Law

The U.S. Supreme Court has agreed to review a challenge to the Patient Protection and Affordable Care Act (PPACA), also referred to as the Affordable Care Act (ACA). The Court chose issues to review from three of the five separate appeals.

The Court will hear arguments concerning the following healthcare reform issues:

  • Is the “individual mandate” provision constitutional? The provision requires most individuals to maintain adequate health insurance coverage by 2014 or to pay a fine.
  • Will some or all of the PPACA have to fail if the individual mandate provision is struck down?
  • Does the Anti-Injunction Act bar some or all of the challenges to the individual mandate provision?
  • Is the expansion of the Medicaid program for the poor and disabled constitutional?

Oral arguments are expected to be heard in March 2012.
