New York City employer failed to pay payroll taxes

The owner of Nastasi Maintenance & Construction LLC and several related companies in Manhattan recently pleaded guilty of willfully failing to pay payroll taxes. Prosecutors for the Internal Revenue Service (IRS) and the U.S. Department of Justice showed that the owner collected more than $1.7 million in payroll taxes and spent the money on yacht maintenance and other personal expenses, including more than $67,000 in cigar purchases, rather than forwarding it to the IRS.

According to court documents, the owner stayed one step ahead of his mounting tax liabilities by shutting down companies and transferring their employees and assets to new ones. The scheme encompassed payroll taxes from 2001 to 2007 for Nastasi-White, Inc., a carpentry and drywall contractor; Nastasi-West, Inc.; Nastasi Maintenance LLC, which provided building maintenance services to Rockefeller Center; and Nastasi Maintenance and Construction.

Sentencing is set for December 2013.
