Payday Loan Business Pays $500K to Employees

A payday loan company that operates under the name Quick Cash has paid $519,088 in back wages to 900 employees to settle Department of Labor allegations that the company violated the overtime provisions of the Fair Labor Standards Act (FLSA).

Department of Labor investigators accused Q.C. Financial Inc. of failing to pay overtime to nonexempt salaried managers and failing to include bonuses in computing overtime pay for nonexempt salaried managers and employees who were paid hourly.

In most circumstances, employers must include nondiscretionary bonuses for regular rate of pay for the purpose of determining overtime.

The company is based in Overland Park, Kansas, and has locations throughout the United States.

The department's Wage and Hour Division in Kansas City conducted the investigation, which covered the period January 1, 2004 to March 31, 2006.
